1. OVERVIEW

1.1. The following terms and conditions (the “Referral Agreement”) govern the terms under which rewards may be earned by our customers (the "Referral Programme"). They apply to Taptap Send UK Limited, Taptap Send Belgium S.A., TapTap Send Payments Co., Taptap Send (DIFC) Limited, Taptap Send Payments Canada Inc. (together, "Taptap Send," “we,” or “us”), and you ("you", "your", or “Participant”), the participant in the Taptap Send Referral Programme. Taptap Send offers electronic money and international remittance services via its App (the “Services”). Participation in the Referral Programme is subject to this Referral Agreement. 


1.2. By signing up for the App and Services, and participating in the Referral Programme for example by making a referral or using a referral code, you agree to be enrolled into the Referral Programme and bound by this Referral Agreement. If you do not wish to be bound by the Referral Agreement, do not share your referral code. The language of this Referral Agreement is English and all Services, instructions and transactions carried out in connection with it shall be in English.



2. PARTICIPATING IN THE REFERRAL PROGRAMME
2.1. The Referral Programme enables you to earn points, rewards, or benefits (“Rewards”) for performing certain “Qualifying Actions”. A non-exhaustive list of Qualifying Actions is included below; from time to time, Taptap Send may add temporary or permanent Qualifying Actions as part of promotional Referral Programmes. Qualifying Actions, dates of any applicable promotional period and any terms and conditions specific to new Qualifying Actions (“Additional Terms”) will be included in any promotional materials published for the relevant promotional Referral Programme, via the Taptap Send mobile application (“App”) and/or via the relevant social media platform(s) used to run the programme.

2.2. Qualifying Actions: The Participant shall receive a Reward for the following Qualifying Actions:

2.2.1. Participant enters a valid promotional code in the App; or
2.2.2. Participant (here, the “Referrer”) makes a “Valid Referral” to a referee (the “Referee”). The following conditions need to be satisfied for a Valid Referral to be made:
      ● A referral is made by the Referrer to a Referee who has not previously registered for the Service;
      ● The Referee registers with the Service;
      ● The Referee enters the referral code given by the Referrer;
      ● The Referee successfully uses the Service to transfer money to a person other than the Referrer in a manner that is compliant with this Referral Agreement and our Taptap Send User Agreement;
      ● The sum of money sent in the Referee’s first transfer is equal to or greater than the minimum transfer amount set by Taptap Send for the Referer, subject to 2.4 below.
      ● The Referee's money transfer transaction is successfully executed and not cancelled (either by the Referee or by Taptap Send).


2.3. Rewards: The amount and nature of the Reward for each Qualifying Action will be disclosed in the App along with the Qualifying Action.

2.4. Taptap Send reserves the right to impose and/or change minimum transfer limits at its discretion. These will be displayed in the App to the Referee. Where a minimum transfer limit is in place, only transfers that exceed this limit will be a Qualifying Action. If a promotional Referral Programme is being run, the Qualifying Action must be completed during the promotional period to qualify.

2.5. Taptap Send reserves the right to change the list of Qualifying Actions and associated Rewards at its discretion without prior notice. However, Qualifying Actions validly completed before the date of the change will be honored by Taptap Send.


2.6. Where not in conflict with any Additional Terms, the terms of this Referral Agreement will govern any Referral Programme. Where there is a conflict between the Additional Terms and the terms of this Referral Agreement, the Additional Terms shall take precedence.


2.7. Any Rewards earned will be awarded directly to your Taptap Send account. They are not transferable, refundable or exchangeable for a cash award. 



3. PROGRAMME RESTRICTIONS

3.1. Participants are required to register with the Service. Only one registration per Participant will be accepted.


3.2. Subsequent registrations or money transfers with Taptap Send by the Referee do not qualify as Valid Referrals.


3.3. Money transfers initiated by the Referee after his or her first successful money transfer with Taptap Send, or referrals to a Referee who is a previous user of the Service, do not qualify as Valid Referrals.


3.4. Taptap Send reserves the right to void any Qualifying Action or payment of any Rewards that: (i) appears to be fraudulent; (ii) appears to have been created as a result of a fraudulent transaction; or (iii) that violates the terms of this Referral Agreement or the Taptap Send User Agreement.


3.5. Taptap Send reserves the right to limit the number of individuals per household eligible for receiving a Reward.


3.6. Any attempt by a Participant to abuse this Referral Programme by using multiple/different identities, registrations, logins, and/or any other method we consider abusive, at our discretion, will void and disqualify the Participant from receiving the Reward in Taptap Send’s sole discretion.


3.7. Residents of certain countries may be excluded from Referral Programmes where local laws make it necessary. Where applicable, a list of excluded countries will be included in the Additional Terms and/or the materials relating to the relevant Referral Programme.



4. DELIVERY, USE AND EXPIRATION OF REWARDS

4.1. Taptap Send will deposit the Reward in your account on the App once the Qualifying Action has been completed. Your Rewards are cumulative and will be displayed as a balance (the “Rewards Balance”) in your account.


4.2. Taptap Send does not guarantee a delivery time on any Rewards granted.


4.3. You may apply your Reward against transactions which (i) would be permitted under the Taptap Send User Agreement; and (ii) meet the transaction size requirements shown in the App prior to your transaction.


4.4. When you choose to apply your Reward against a particular transaction, your entire Rewards Balance will be applied against the transaction. Taptap Send is unable to apply partial amounts of your Rewards Balance.


4.5. By applying your Reward against a particular transaction, you increase the amount that your Recipient receives, without increasing the amount you pay from your Payment Method (as defined in the Taptap Send User Agreement). You will have an opportunity to review the amounts paid and received, and the Rewards spent, prior to executing the transaction through the App.


4.6. Rewards are not electronic money and are not refundable, even if the accompanying transaction is eligible to be refunded.


4.7. Rewards expire ninety (90) days from the date that the relevant Rewards are deposited into your Taptap Send account. Taptap Send will automatically deduct expired Rewards from your Rewards Balance.


5. LIMITATION OF LIABILITY

5.1. TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTIONS, IN NO EVENT SHALL TAPTAP SEND BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES ARISING FROM YOUR PARTICIPATION IN THE REFERRAL PROGRAMME, INCLUDING BUT NOT LIMITED TO SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE AND/OR CONSEQUENTIAL DAMAGES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TAPTAP SEND’S MAXIMUM AGGREGATE LIABILITY TO PARTICIPT AND ANY THIRD PARTY UNDER ANY AND ALL CIRCUMSTANCES SHALL BE THE THEN-CURRENT DOLLAR VALUE OF THE PARTY’S UNSPENT REWARD.


5.2. ALL WARRANTIES, EXPRESS AND IMPLIED, REGARDING THE REFERRAL PROGRAMME AND USE OF THE TAPTAP SEND SERVICES ARE DISCLAIMED (INCLUDING, WITHOUT LIMITATION, THE DISCLAIMER OF ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF INTELLECTUAL PROPERTY AND/OR FITNESS FOR A PARTICULAR PURPOSE). TAPTAP SEND MAKES NO REPRESENTATION OR WARRANTY WITH RESPECT TO ANY RESULTS OBTAINABLE THROUGH THE REFERRAL PROGRAMME OR THE DELIVERY TIME OF THE REWARDS.



6. OTHER TERMS AND CONDITIONS

6.1. We reserve the right to amend or terminate the Referral Programme at any time without notice. Resolution of all questions or disputes regarding eligibility for the Referral Programme, earnings of Rewards, or your compliance with the terms and conditions of this Referral Agreement shall be subject to our reasonable interpretation.


6.2. If a Participant or Referee attempts to use the Referral Programme in breach of this agreement, the User Agreement or in violation of any law, statute or governmental regulation, we will have the right to suspend or terminate the account under the User Agreement or void the Rewards of either party.

6.3. All information collected in the Referral Programme shall be subject to our Privacy Policy.
